Spain's Public Procurement Advisory Board included Report 24/2026 among the opinions adopted on 22 October 2026. It addresses the application of the ninth additional provision of the Public Sector Contracts Act when procuring a general-purpose artificial intelligence model, as well as how to classify such a contract.
Why does this matter to suppliers?
AI vendors should pay attention to the legal structure of the contract, required deliverables and tender conditions. Eligibility, guarantees, data-use provisions and award criteria all merit careful examination before bidding.
